浏阳市市场监督管理局开展花炮及原辅材料产品质量专项整治行动。

在促进浏阳花炮产业转型升级进程中，提升烟花爆竹及原辅材料产品质量是其中重要一环。为了依法打击生产销售不合格烟花爆竹及原辅材料的行为，促进浏阳花炮产业转型升级，3月份以来，浏阳市市场监督管理局联合市鞭炮烟花产业发展中心、市应急管理局等单位，成立综合执法队伍，深入开展了为期3个月的烟花爆竹及原辅材料产品质量专项整治行动。

强监管，加大执法力度

质量抽检、“清仓”行动、集中约谈、“红黑榜”公示、联合惩戒……在此次整治行动中，相关单位拿出“硬”措施，向烟花爆竹及原辅材料领域的产品质量违法行为“亮剑”。

截至目前，此次整治行动共完成原辅材料产品生产、经营、使用环节质量监督抽检358家696批次。其中，抽检烟花爆竹原辅材料生产、经营单位72家121批次产品；抽检黑火药生产企业29家57批次产品、引火线生产企业22家43批次产品；开展烟花爆竹生产企业原辅材料“清仓”行动，累计抽样235家烟花爆竹生产企业475批次产品。

针对发现的烟花爆竹及原辅材料产品质量违法行为，目前已立案79起，共没收商标侵权、产品质量不合格烟花爆竹成品1000余件。5月19日，市市场监督管理局对没收的1000余件涉案产品进行了集中销毁。

此外，市市场监督管理局还联合市应急管理局、市鞭炮烟花产品发展中心下发了《关于严格执行强制性标准确保产品质量的通知》，要求全市烟花爆竹生产企业严格按照相关强制性国家标准组织生产、经营；组织企业签订《烟花爆竹生产企业产品质量承诺书》，要求各烟花爆竹生产企业主动履行产品质量安全主体责任，确保产品质量符合强制性标准的要求；组织约谈烟花爆竹原辅材料相关经营单位，要求采取有效措施保证产品质量。

建机制，实施联合惩戒

5月9日，市市场监督管理局、市鞭炮烟花产业发展中心联合公示了第一批烟花爆竹原辅材料抽检情况，第二批于5月20日进行公示。截至目前，已累计公示烟花爆竹原辅材料抽检结果107批次。

若企业不遵守相关规定，所生产产品屡次出现质量问题，该如何处理？为此，市市场监督管理局制定了烟花爆竹原辅材料产品质量“黑名单”制度，通过建立产品质量信用监管体系和质量倒逼机制，督促烟花爆竹原辅材料生产经营单位全面履行产品质量主体责任。

据市市场监督管理局相关负责人介绍，有下列情况之一的单位，应当列入“黑名单”：

在一个年度内，在本级（含）以上烟花爆竹原辅材料产品质量监督抽查中出现二次以上（含二次）不合格或出现严重不合格的单位；在一个年度内，因烟花爆竹原辅材料产品质量违法行为，被市场监管部门（含外省）立案查处二次以上（含二次）的单位；发生重大产品质量违法案件或质量事故的单位；因烟花爆竹原辅材料产品质量违法行为被依法吊销（撤销）行政许可证书的单位；因产品质量问题导致安全事故的单位。

每年的6月30日前和12月31日前，市市场监督管理局将通过新闻媒体、门户网站向社会公开这份“黑名单”，并通报相关的行业协会以及相关的行业主管部门或政府。

“对列入烟花爆竹原辅材料产品质量‘黑名单’的单位，我们将依法组织实施联合惩戒措施。”市市场监督管理局相关负责人表示，对于列入“黑名单”的单位，不仅会增加监督抽查频次，还将对企业相关资质认证、经营活动等进行限制。当产生新的违法违规行为时，还将依法依规从严从重处罚。

优服务，助力产业基础提升

在对不合格产品进行销毁、对违法企业进行惩戒的同时，市市场监督管理局也十分注重对烟花爆竹产业的指导和服务。

浏阳作为湖南第一批参与国家“百城千业万企对标达标提升专项行动”的城市，把烟花爆竹产业纳入全国对标达标提升专项行动，提交了326项标准的比对，培育出57家烟花爆竹企业标准“领跑者”，支持浏阳烟花爆竹总会发布了12个浏阳花炮传统小型产品团体标准，进一步提升了烟花爆竹行业的标准化水平。

近年来，市市场监督管理局还多次组织召开烟花爆竹产品质量提升专题培训班，累计培训2000余人次；通过编制烟花爆竹生产企业质量管理和产品检验培训资料，开展质量管理、质量标准、质量检验专题培训，指导企业成立质量管理和标准化机构，完善质量保证体系，落实自检制度，不断提升烟花爆竹企业管理者和从业者的质量素质。

同时，市市场监督管理局还注重浏阳花炮的知识产权保护，2003年，原国家质检总局批准对“浏阳花炮”实施地理标志产品保护。2007年，“浏阳花炮”被正式认定为中国驰名商标。今年，市市场监督管理局除严厉打击烟花爆竹行业的商标侵权违法行为外，还协助浏阳市星辉烟花爆竹经营有限责任公司申请了“烟花屋”“烟花WOO”等6件商标、“烟花屋”等2件外观设计专利，对“烟花小屋”进行了知识产权保护。

Mechanisms to implement joint disciplinary action

At the same time as the destruction of unqualified products and the punishment of illegal enterprises, the Municipal Market Supervision Authority also attaches great importance to the guidance and services of the fireworks industry.
